I think what the Supreme Court said was that a President cannot be prosecuted for doing things that are part of his official Presidential duties. So the question would be, is a drone strike on Trump an official Presidential duty, or something done for his personal benefit? I think Biden could be prosecuted on that basis. Because a drone strike on a political rival is not an official Presidential duty.
That would really be a slam dunk case.
I can't believe that someone of your supposed intelligence would question the great latina Supreme Court Justice (the 2nd stupidest one in history).
A current president can do whatever they want. The other branches are there to check and balance them. If they do anything illegal, they should be impeached and then forward the case to the justice department for criminal charges. After the fact, there is a much higher level that you would have to prove as laid out by the SC.
In this specific case, the military can't legally take out a political rival. Using the military against an American citizen, on US soil, would not be legal and any person in the military should not follow the order. If he did this, it would be an illegal action and if he wasn't impeached, it would meet the level to allow prosecution after leaving office.
If Biden wants to arrest his political rival, like he has done, it would be borderline. He could be impeached but we know there won't be an impeachment for either side unless something changes in the future. After he leaves office, there would have to be corruption directed from the president to allow prosecution. The question of that being an official action would also have to be decided as the standard would be lower if it wasn't an official duty.
