I don't recall that gawker sold the tape, I don't know if they paid for it. The idea that the press cannot report, show, or otherwise distribute dirt on a person is kinda silly, that's mostly what the entire industry exists for.

Is there a note in the Constitution that says the government should refrain from ruling on them? Because there is clearly one about the press.

They are. As long as they aren't breaking laws like dealing with stolen property, posting things on their website they were told not to because it is an invasion of one's privacy, etc.

Not sure how I'm supposed to feel bad for Gawker (their shoes in this case) for using stolen property to release video/images of someone doing the dirty in a private setting.

Laws need to keep up with the times, and the founding fathers never could have imagined in their wildest dreams about the technology that is available to us today. When they wrote those laws, stories of George Washington bending Betsy Ross over her sewing loom would NEVER have been printed in a newspaper...

So keeping up with the times means moving towards authoritarianism and a restriction of rights then? You're right, they never would've had the internet so we need to have speech codes. They never had automatic weapons so we need confiscatory gun control laws. Church? No one needs that anymore, we should ban it or at least fine tax those who choose to attend. The whole problem is that when someone gets to draw the line then that person has the power over where the line is. I'm not ok with that and you shouldn't be either.

It's not journalism or news when posting a copy of a video when part of the party was not privy to it being filmed. If Gawker played the "But we didn't know card" then that makes them even less of a "news" outlet for not doing any research into it.

Many lines are drawn and they were then as well. There is a reason why. Because freedom, true freedom has costs as well. If people were free to murder than that would effect those who don't want to be murdered. If people were legally allowed to drink and drive than we would have more lost lives than we do now. If people were allowed to blow up buildings than it would cost people lots of $ and put insurance companies out of business. If people were free to abuse pets without recourse than we would have even more abused pets. Everyone wants absolute freedom until it infringes on what they think is right. You want no line drawn, but have already drawn lines yourself.
