Maybe. I think a personal conversation of the sort the cops were having is one that strips them of the right to enforce the law. You can't really make this a "no matter what" kind of issue, that conversation constitutes a moral hazard.

If the conversation reveals information that materially affects their ability to do their job, or represents extremely poor judgment in choice of topic and venue, it's possible. If I were to approach a coworker and tell him that the new girl in accounting has a sweet, sweet [BLEEP] and I want to tap it and someone else hears it, would HR be wrong to recommend my termination?
