Sexual assault, involving two other players (Seahawk and 9er.)
Early investigative stages. I didn't link a story because it links to TMZ and other sites that may be explicit.
FYI for anyone who wants to look for it themselves. Not a good situation to put themselves in.

She later “mixed some drinks for all of them and gave them shots.” She claims the men “told her that in order to drink the shots she had to ‘hit’ the bong which contained marijuana.”
The woman says she began to feel lightheaded and went to a bedroom to lay down. Kaepernick allegedly entered the room “and started kissing her.” He then began to undress her. Kaepernick said he’d be right back and left the bedroom. She waited naked in the bed, and Patton and Lockette opened the door and “peeked” inside. She says she told them to leave, they closed the door and left, and she remembers nothing after that.
The woman claims that she woke up in a hospital bed, and that she doesn’t recall how she got there or who took her there. She also said that she has had a sexual relationship in the past with Kaepernick.
While the report states that Kaepernick and the woman did not have sex before he left the room, the report doesn’t say whether evidence of intercourse was detected at the hospital. It’s also unclear whether the victim or police believe that she was drugged.

Going off of the account of the woman as reported by tmz...I don't know how they can get him with any kind of assault. Seems a little weird...

That's the potential problem I'm taking from this.
Even if nothing comes of the investigation, the 49ers now know two of their players were witnessed in possession of marijuana.

That in itself is not a crime, especially coming form someone with a questionable account of the day the supposed events took place. Now if the NFL just happened to do a "random" drug test today and it came up positive that would be a different story.

No, but they can do an immediate drug test on all 3 players. That could bring SF one step closer to the Blaine Gabbert era. That would certainly be entertaining.

I'm not saying it's a crime. Never even suggested it.
But it might be enough for the team and/or NFL to put the players in the program if they want to.

A failed test or a "behavior" issue such as a drug-related arrest will put a player into Stage One of the league's intervention program. There is no discipline such as a suspension in Stage One; a player is instead subject to additional testing and a treatment program at the discretion of the league's medical director.

The rules are vague enough that the owner or league could put possibly them in the program. I don't believe it even requires an arrest (the quote gave merely one example that was, which isn't all encompassing.)
Again, not a good situation to put themselves in.
