I find it hard to believe that after sitting in the cup for X amount of minutes after pouring, that it would be as hot as claimed. Was she carrying her own bunson burner too? And its human error that resulted in the spill. 

 

My problem isn't with the lawsuit, but the amount of the lawsuit. Wasn't it for millions of dollars?? 

 

I'd say suing for the amount of any medical bills, plus lost wages for work, and maybe a reasonable "pain and suffering allowance" would have been fair. but to sue for millions just shows you it was a money grab. Typical of todays lazy, opportunistic trash.

The 79 year old woman, Stella Liebeck, was awarded $160,000 in medical expense recovery and compensatory damages, and $2.7 million in punitive damages. Liebeck initially sought $20,000 for current and future medical costs, as well as lost wages, but McDonalds counter offer was $800. She hired a lawyer who really went after McDonalds. The judge reduced the punitive amount to $480,000 and after appeals by both sides, they eventually settled out of court for something less than $600,000.

 

She bought the cup of coffee at a drive through, pulled into a parking space to add cream and sugar. She put the cup between her legs, pulled the lid back towards her and the coffee spilled, absorbed by her cotton jogging pants. She had 3rd degree burns on 3% of her body and lesser burns on 16%. She spent 8 days in the hospital, receiving skin grafts in addition to normal burn care.

I remember when this happened. It is indeed very easy to receive severe burns when scalding hot liquid is absorbed by clothing. The trial was called frivolous by many, but there were quite a few people who felt the packaging could have been better considering the high temperature and risk of serious injury.

If it was in a covered styrofoam cup... it's possible.  I burned my lip to near blistering on McDonalds coffee once thinking it had cooled enough after letting it sit for 10-15 minutes.  (I had opened the flap - but left the lid on) I always take the lid off now for awhile.  (and I don't get coffee from McDonalds unless i'm in a pinch.)

 

And - yes - Americans are often too litigious - but that one seems fairly justified and a drop in the bucket for MCDs.

I also saw all of this on HBO.  All she originally wanted was her medical expenses covered.

Theres so many lazy, money grabbing overly-litigious leeches running around just scouring for an opportunity to sue big business so they can get their payday.

 

If I was off on that ONE incident then thats a miracle. Most of 'em are just as I cite.

The Little Caesars 5 dollar pizza commercial where the guy with the arm cast breaks the cast to get his change. Its disturbing. 

 

Also, on the same commercial, them labelling the BURNT cheese on the sides of the pizza as "caramelized cheese edges" ....lol, so they found  a way to burn your pizza and you to think its a good thing!!

Just to add to the above.... I'm sure many of the lawyers themselves aid in this mindset, as they get paid handsomely in those large cash award incidents I speak of , too. So they absolutely deserve some of the blame.

People who have apparently never learned the art of conversation.   They just want to talk.  And talk.   And talk.  They don't want to listen.  They don't allow anyone to get out more than half a sentence before they interrupt. 

 

That's another pet peeve of mine.
