I assume you reviewed the School Districts Student-Parent Handbook and their Standards of Student Conduct prior to making that above statement so I'd love to know what your basis of that assumption.  My interpretation of the policies indicate the school had every right to consider the shirt a violation.  As a result, the student has no basis to file a claim.

Times have changed though, the DemocRATS run the educational system and don't allow opposing views to be heard.
I say abolish the NEA and the Teachers Unions and put education back under local control.

I can't speak for the thousands of shirts that are being worn as reflected above, but the Policy is very discretionary which places the judgement in the hands of the school.

I don't disagree that there may be partiality in their judgement but the school will win this case if it ever goes to court.

It doesn't really matter what the school policies are, the courts (including SCOTUS) have usually sided with the student(s) in similar cases as it is a Constitutional issue.

You obviously didn't read the School's Standard of Conduct link that I provided.  I even told you where the answers were that gave the School such rights.

I don't think a public school system can write rules that go against the Constitution; and if they do, they never hold up in court, because the Constitution trumps everything. It's not the military - we don't sign over our rights just cause we go to public school.

It doesn't really matter what the school policies are, the courts (including SCOTUS) have usually sided with the student(s) in similar cases as it is a Constitutional issue.

They also tend to rule against any policy too subjective or that contains too many ambiguities. It’s also stated they are “general guidlines”. The fact that he was provided the opportunity to comply with their policy enforcement and then was further punished for excepting said remedy won’t sit well with most judges.
