So I guess the moral of the story is that it's ok to murder civilians and POWs as long as you're a Navy SEAL with friends in the right places? We send foreign war criminals to Gitmo before they get to trial. Why should an American war criminal not be held with "rapists and pedophiles"? Or, you know, with his buddies in Gitmo? Pathetic. No, I think that the shooter should have reasonable belief that the target is a hostile, but even making a mistake while in that environment under constant threat of death isn't the same as premeditated murder.
There's going to be a trial, due process, and it's not going to be swept under the rug. That's what needs to be done. That's not antithetical to treating our fighters with a basic level of dignity. You seem to have missed that part. Trying to compare a holdover for terrorists (GITMO) with no legal status is not, well, comparable to this situtation in any form. In most cases, those individuals were actually hunted down because of their wanted status. Chief Gallagher is going through beginning stages of a court-martial. Confinement is required in this situation unlike in the civilian world where you can be released on bail during discovery. As far as the alleged issues, they are just that, alleged. The "POW" and I use the term loosely, was injured in fighting and could not get away. He was taken prisoner immediately and died due to injuries shortly after. There is no proof that a knife was anywhere near the prisoner other than to do a cricothyrotomy. As far as firing rounds at "civilians", it happens quite often as there is not a distinct military uniform for ISIS or other terrorist organizations that employ Men, boys, women, children, and even criples. It will all come out in his trials. My guess is he will be cleared of all but conduct unbecoming for the photos and texts. Still, he won't get off lightly. He'll end up being fined, credited with time served, receive reduction in grade, and given a bad conduct discharge. |
