Look at the Brooks hand as he's running and then falls, the taser falls out of his hand a few feet ahead, just a bit out of view with the parked car. He had no weapon on him during their search and had no weapons on him after the chase and shots.

The DA simply took the warrant to a judged and asked for it. He doesn't have the shooting officer's testimony, and Howard didn't even consult the GBI before getting the warrant.
