From looking at the videos Trump turned his head to the right. That just may have saved his life.

The way I'm seeing the layout is the shooter was on that side. From the camera angles, the fans seated to the right, Trump's left, were the ones shot. He waited until Trump looked that way to fire, probably because of his TDS and wanting to see Trump. It probably did save Trump because if he was looking forward, it doesn't end that way.

But yes, if it was an order, Biden could not be prosecuted for that.
It would be an unlawful order, an order that must not be followed, but Biden would be immune from prosecution.
Impeachment would be the remedy.
That is, until Senators start caterwauling and saying that it's not their issue and it really should be a criminal matter.
