It was going on before he resigned when he sought reelection so I’m not sure if that would stop him or not.

I've also read that he stepped down because of Mitch McConnell and 3 more stooges would'nt give their votes, and also needed approval from both The House and Senate for a recess, which he wasn't going to get.

Garland dropped his investigation.  It was the House Ethics Committee that was still investigating him.

It's interesting.  I googled, "why did the DOJ drop the investigation into Gaetz," and I learned, the DOJ investigation actually started during the Trump administration.  That investigation was into whether Gaetz had sex with underage girls.  Nothing else.  The DOJ under Biden then dropped that investigation.  The HEC investigation apparently involves a lot more, namely, the sex with underage girls, PLUS, whether he 
used illegal drugs, accepted improper gifts, gave special favors to personal contacts, and obstructed the HEC investigation into all of that.

Since he resigned from Congress, the HEC no longer has jurisdiction.  So, he gets off the hook for that one, too.

Remember, the DOJ investigation started during the Trump administration.  Garland inherited it.  So maybe he said, screw this, I don't want to waste my time going after members of Congress, and since the DOJ had asked the HEC to stand aside while the DOJ investigation was going on, Garland figured the HEC could handle it and he had better things to do.  So he dropped it knowing the HEC had their own investigation and they could handle it as they saw fit.
