It isn't going away that is for sure.  I heard the testimony from the victim.  She seemed to remember a good amount of details and then everything was blank...  She even asked for Kaep when the two guys peaked in.  Also told them to go away which they did.  I'm sure there is still more to come out.

 

And please people, have a little respect for the victim and at least wait till more information comes out before you start calling a potential assault victim names.  It just makes you look backwards and extremely foolish.

As a union employer, I had the right to ask any employee to submit to a drug test for any good reason.

 

This is enough to warrant that, easily.

 

Per union agreement, if the employee refused they were terminated.

 

The NFL isn't that harsh, but there's no evidence to me that says they can't be put in the program for such alleged behavior.  We'll have to see what comes of the 49ers own investigation.  The thing is, we don't know how many people are in stage one of the program because it isn't public.  We only hear after the fact when they fail again, and enter step 2 (only then do we ever know they were ever in step one to begin with.)

That would be like me telling the police that you are hitting bongs in your living room. Do you think that would give them the right to search your house?

 

They may question you about it but all you would have to do is deny it and if there is nothing to corroborate my story, it would be dropped.

 

People lie. You can't violate someones rights or move someone up in a progressive disciplinary process based solely on one persons word, especially if you have multiple people to deny it.

Yes, but I don't think they could do so on hearsay.  They can drug test them, but doesn't take long for that to get out of their system.  If that is the case, can't anyone just make a claim that someone smoked pot just in spite?  I just think you have to draw a line somewhere.

If there's nothing to hide, then there's nothing to hide.

 

If I were truly innocent, I'd gladly submit to a drug test to clear my name and prove my word against theirs.  The only way I wouldn't is if I knew I was lying.

 

We'll see soon enough if they're willing.  And if they aren't then their word isn't worth squat, even if corroborated.  The guilty corroborate stories all the time, so there's no bombshell there.  At least, I hope that's not a bombshell to you.

Yes, but this happened in April.  You can drink enough water over a weekend and get it out of your system.  I just don't think that is some smoking gun.  And it doesn't prove they didn't smoke pot.  Just proves they don't have it in them at the time of drug test.

Good reason isn't someone that doesn't work for you claiming the employee was doing drugs off the job.

 

I'm not sure what union you are talking about, but I have never heard of a union allowing people to be tested at the whim of the employer unless they are found to be under the influence, and even that suspicion would have to be corroborated with other management personnel.

Doesn't the NFL already have a random drug testing policy in place that was agreed upon by the NFLPA?  They don't need a reason, but if there's a report out there that he may have been indulging in a little wacky weed, you can rest assured his random drug test is probably going to be happening pretty quickly.

I would imagine he probably needed to start that as soon as a report was taken because the league doesn't play games.  If there is a suspicion of drug use, the testers show up wherever the player may be.

The random drug tests for recreational drugs only occurs between April 20 - August 9 unless that person is already in the substance abuse program.

Hasselbeck was just joking on Twitter the other day about the random drug test he had to do.  I'm pretty sure he's not in the program.  Not sure if that date is accurate.

I know this is extremely nit-picky but the USA Today article didn't state that she actually saw any of the players hit the bong. Just that she was told to hit it.

 

Could be none of them did, or only one of them did - who knows?

Either way this isn't something that will bump them into the drug program.

 

Either nothing at all comes of it or it turns into a Darren Sharper thing and they get suspended indefinitely for conduct detrimental.
