Simple question.  If you are going one or two miles over the speed limit, are you technically breaking the law as it is written?

 

Technically, yes but Im always confused when they hand you a copy of the ticket and the fines only start with you going over the speed limit 7+ miles.

Someday I'll have to tell you about my encounter with the South Dakota State Police. I wasn't carrying at the time (last fall), wasn't even into weed yet, but this joker was sure as hair on a dog's butt that I was carrying, and tried every trick in the book to talk his way into my car. I got out of it with no search and a warning for going 68 in a 65

Elected city leaders have to be sweating bullets over this too. I highly doubt the chief of police was this concerned with the town's balance sheets. He was ordered, or encouraged, to enforce quotas. If he falls someone is going down with him.

We have the same kind of thing going on up here in VA where it was discovered that Troopers from a county were being passed over for promotion due to low ticket-issuance numbers. With the Governor being on trial and all, they are going to offer up someone on that staff as a sacrifice.

1.   The law is unenforceable as written, as the error between a legally functioning motorists speedometer and any radar unit is 2 to 4 mph.

2.   FDOT states that all vehicles are granted a 5mph variance to allow for inaccuracies.

3.   Now adays Waldo and Lawtey write mostly 10+ as the fine is larger and many motorists have fought and won on 2 over.

 

All of you who have run that gauntlet are well aware that to just slow down grants immunity as their is always those who do not.

Waldo and Lawtey are burned into the collective knowledge of N. FL and Waldo jokes are DOOMED, you were collaterial damage dude.  The Governor of Florida placed the billboards outside of Waldo and Lawtey proclaiming it a Speed Trap

years ago and they are still up after 25+ years.

Absolutely.  I was just responding to the guy who posted about people getting pulled over when there are signs warning you of the speed trap.  I think reasonable people will assume if you're two miles over the limit your safe (you are in most places).  Not Waldo and that's why people get pulled over in spite of the warnings.

 

Personally I've never been pulled over there but I was ticketed about 5 years ago in Nassau county for doing 38 in a 35.  Paid it too. 

I don't know what the law was 5 years ago, but now, you cannot be ticketed for speeds up to 5MPH over the posted limit. This is law per Florida statute 318.18 b
