How did they figure this out?  They had Jastremskis phone.  just like they had belichicks phone, the equipment managers phone, assistant coaches phones etc. etc.  In all that mountain of data we isolated about a dozen texts over the course of almost a full year and hundreds of thousands of pieces of individual correspondence that then had to be taken out of context!  

 

2.) Prove to me that Tom Brady RECALLS the conversation and lied about it.  Could it be that he was asked about it what 3 months after the conversation took place?  what was the topic of conversation over dinner with your wife on 4/22/15.  hurry up you better be specific and don't tell me you don't recall because that's just not plausible.  

 

3.) the commissioner and your ilk are so desperate to support this witch hunt that they use the fact that Brady made it clear his preference was 12.5 as an inference that he wanted to circumvent the playing rules.  That's preposterous.  That's like someone saying "i drive the speed limit" is proof of reckless driving!

 

4.) NFL EMPLOYEES were caught RED HANDED tampering with game balls for personal financial gain to sell memorabilia and facilitated the introduction of a K ball to the referee for PLAY!   And that's in the AFC CHAMPIONSHIP GAME.  

 

5.)Walt Anderson DOES NOT RECALL what gauge he used to measure the footballs before the game.  a.)The purported difference in PSI drop between the colts footballs is Fundamentally congruent with the difference of sensitivity the two gauges and b.) based on the readings at halftime of the logo gauge the patriots balls were more likely than not inflated to the proper level of inflation before being exposed to game conditions.  (The NFL LIED about that when they leaked the idea that we were talking about 2 pounds or more to the press).  c.) Walt Anderson didn't know during the game if he remembered to initial all the game balls or not.  d.) During the measurement at halftime there is observed anomalies in the recording of Data.  e.) Post game some of the patriots re-inflated (by the refs) footballs measured above the legal limit of ball inflation which is a direct violation on the part of the REFS of the same rule that Brady is accused of breaking.  The same allegation has been made about the refs during the Jets game.  So WHAT INTEGRITY!  f.) and most importantly...  huh...  During half time, when the first ball from the Indianapolis Colts averaged below legal limits on both gauges THEY STOPPED MEASURING FOOTBALLS.  you want to talk about phantom Text messages, THE CHAIN OF DIRECT PHYSICAL SCIENTIFIC EVIDENCE FOR THE CONTROL GROUP OF FOOTBALLS WAS CUT OFF THE MOMENT IT BECAME INCONVENIENT TO THE NARRATIVE THE LEAGUE ADMITS THEY BEGAN TO CREATE BEFORE THE GAME!!!  Explain that, justify that, and then get back to me!

 

that being said, by any rational understanding the initial finding of probable cause for an investigation based on the hap hazard data collected during the game, in the fundamental and admitted absence of standard protocol to monitor PSI levels, would be THROWN OUT!

To me it's crystal clear the NFL failed to make their case against Brady.  In the end, they had no direct evidence.  They could only say that "something" happened.  They don't know who did that something, how someone did that something, or whether Brady knew about whatever was done.

 

So, since all they could actually prove is that "something" happened but didn't know who or how... I can understand the team punishment.  There was no smoking gun.  There were no fingerprints.  There was only the product of "something" happening by "someone" to reflect on.

 

Looking at the facts of the case, they had nothing on Brady and still don't.  That's what God-El is angry about, and he didn't pursue any of the information Brady gave them because he chose not to.  Some folks must not text if they don't realize a text with a contact shows up on both phones, and there weren't any incriminating texts from him on the subject to either of the guys the NFL think (but again didn't prove) may have deflated the balls.  If the NFL had bothered following up on the information Brady gave them, they likely would have found the same thing to be true with his other contacts as well.

 

Why didn't they?  They admit to laziness.  The real answer is that if they followed up they couldn't stand by their take that he was uncooperative, because he cooperated by giving that information.  By ignoring it, they fell back on their predetermined conclusion rather than following the facts they failed to obtain.

And part of labor law requires that even in instances where individuals or entities are granted special powers of discipline within the realm of their private industry the party exercising said power still has to act with a reasonable measure of Fairness and Symetry.  You can be the judge jury and executioner, but you can't continually rewrite the law as you see fit.  

 

As you just pointed out, the discipline handed down is being based on a lack of cooperation.  1.) the initial requests could be deemed unreasonable based on the fundamental stance that the union takes about its employees handing over electronic devices carte blanche.  2.) Brett Favre was cited for non cooperation, he didn't hand over his cell phone and he got a 50k fine.  That's a long way from four games and having your name raked through the coals.
