Kentucky Clerk Is Jailed For Refusal to Issue Marriage Licenses As A Result Of Her Religious Beliefs

Quote:And you don't have to marry interracial couples.

This may blow your mind but probably in the boondocks there are many pastors who share the same sentiment. It's how they feel.

Quote:Except I'm not a Pastor in this scenario. I'm a court clerk, and I'm not allowing my employees to issue marriage certificates to interracial couples.

Same thing applies.

You can go to a small hick town and encounter the same practices. They won't flatly deny the license, but make it difficult ie drive to another town that could be miles away.

The point is if I wanna marry a White woman in Kentucky, I'm not gonna cry because this clerk refuse to issue the license. Go to another clerk.

These problems are going to keep happening because people are too damn ignorant to know how to separate church and state..

It's okay for me to have my religious rights be violated to 'respect' or appease others.
Literally zero of your religious rights are being violated. This idea that not being able to discriminate is a violation of your rights is about as insane was lobbying for a theocracy...

Quote:It's very possible that resigning is the only viable option for Kim Davis.   I think Kim Davis should speak to as many highly qualified attorneys as possible though.
It should have been her only option from the beginning. She will not do her job. She ought resign but then some presidential candidates and religious zealots won't have their martyr so here we are.

But then who would the Huckabees get to have photos taken with?

Refusing to do your job you were elected to do while swearing to uphold the letter of the law is not a first amendments issue. Based on your limited postings it's not surprising this is lost on you.

As far as I'm concerned, these are the facts as I understand them.

Kim Davis was refusing to issue, or allow those on her staff to issue marriage licenses to same-sex couples based on her religious point of view.

She was taken to court and ordered by a Federal Judge to issue marriage licenses to couples that are eligible to receive said license as required by law
.  She once again refused citing her personal religious belief, so she was sent to jail for Contempt of Court (refusing a lawful order by a Federal Judge)
.

She has now been released under the condition that she does not interfere with the duties of her office, or those deputies serving under her.  If she does, then she will once again be guilty of Contempt of Court, and faces going back to jail.

This has nothing to do with religious freedom and everything to do with the Rule of Law.

Two separate issues son. And we're not exactly on opposite sides of both issues.

I'm taking a wait and see approach and support Kim Davis if she doesn't do what's considered her job.   But there's no question that she might have to resign.   If Kim Davis decides to resign,  I expect to support her decision.

Being that Ted Cruz and Mike Huckabee have been my top two choices in the 2016 Presidential Election,   that's certainly not going to change based on the Kim Davis developments.

I lost all respect that I had for him with his involvement in this.

So let's look at what the 1st amendment says.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

She is not exercising her right to practice her religion while working in a government office.

Look at it another way.  She is viewing marriage from her religious point of view.  However, she is wrong when it comes to the legal point of view.

You can believe anything you want. But you can't make me play by your rules. Go not marry gays on someone else's dime/time.

Her attorney has said that she will not follow that condition. Clown shoes.

Just to be clear. You support her violating the law and the candidates that support her violating the law.

The validity of the ' law'  is definitely an issue on this end.

As long as Kim Davis remains in her position,  I definitely believe she shouldn't issue the licenses that she has refused to and no one working under her should issue the licenses.
