Hulk Hogan Gets $115M Verdict Against Gawker at Sex Tape Trial

#21

Quote:It's not, it's free press. Hogan is a public figure and therefore his actions are newsworthy.
Public figure is only a defense if the tape was newsworthy and it very much wasn't. As it is, it's just a massive invasion of privacy.

Quote:Hogan only brought this claim after his copyright suit got tossed out of court. He doesn't care about privacy, he just wants his cut.
Let's assume what you say is true. Still has nothing to do with the first amendment.

Quote:well Erin Andrews was secretly recorded in a hotel owned by a public company, not a private dwelling...There is an expectation of privacy when renting a hotel room and that privacy was breached
I agree I was just countering his public figure claim.

Who are you to determine newsworthiness? Who is the government to do so?

Congress shall make no law abridging means that they have no say in news work. Defining what is or is not news with millions of dollars in fines creates the chilling effect of stifling free expression and a de facto regulation of the industry.

It's a sad day when Hulk Hogan is worth more naked than Erin Andrews is.

When you get into the endzone, act like you've been there before.

That's a scary road that you'd like to head down. Luckily you are wrong.

I don't, but thankfully we have this called the justice system. In this system there are judges and juries who can make decisions about these sorts of things. Even better is that anyone can take a complaint to this justice system to have it resolved and you can hire these people known as lawyers to help you make your claim. It's really one of the most under appreciated marvels of modern civilizations.

We have this document that says certain topics are beyond the reach of these people because they are just fallible people. Talk about under appreciated...

That you think the document covers this gawker website is laughable.

That you think the government should be able to shut down the reporting of news through a punitive verdict such as this is terrifying.

The fact that you think a recording of a private act is news is a little terrifying too.

I do not think that, and never implied as much.

We're debating what is and isn't newsworthy. I don't believe the government should get to make that decision. In rendering this verdict the government has done so.
