Well given from the video that she didnt, this is also not relevant. Mixon said that exact statement to try and best to justify dropping a bomb on a lady he had been harrassing.

Now I did not take the time to research the Oklahoma statutes or case law for all of the applications for assault, battery and self defense laws, so for the purposes of this discussion I'll go with what's been presented here on the board (a dangerous practice, granted,but...).

 

Assuming Roycee's account of events is accurate, then according to you, legally she started the fight with the push...right?

 

This is Roycee's account:

Mixon was looking for trouble, found it and got a tap on the wrist for it. He had multiple chances in the video alone to remove himself from the situation he didn't.


And this isnt his only incident at Oklahoma. He was suspended this past season for a game
Now, ROycee, taking your account at face value, is there anything SHE could have done to avoid the physical altercation?

At the :28 mark, Mixon is facing the guy, not the woman.

 

At the :33 mark, Mixon appears to be walking away. 

 

At the :34 second mark, the woman got up and pushed Mixon.  Mixon then fakes as if to hit her.

 

 At the :35 second mark, she slaps Mixon.

 

Might there have been communication between the parties prior to entering the restaurant?  Yes.

 

Might Mixon have been obnoxious to them prior to entering the restaurant?  Yes.

 

Might they have been obnoxious to him?  Yes.

 

Might Mixon's response to her pushing and slapping him have been disproportionate to the use of force against him?  Yes.

 

Based upon the video, had Mixon used ANY physical force against her prior to her pushing and slapping him?  No.

 

The point is, Mixon may well have been morally or legally wrong to have hit her.  But based upon the video, she does not have clean hands here, either.  She had opportunity to de-escalate the situation and she didn't.


 

Worst to 1st.  Curse Reversed!

He should have exaggerated a little more. "It felt as if she had the hands of a prime George Foreman". I bet that wpuld have swayed public opinion a little better.


Maybe that parking attendant should have said that they felt like Mixon throwing that ticket was like getting hit with a Nolan Ryan heater. They would have been justified in running Mixon over with a golf cart.

While its hard to tell without being in that situation, surely if you are able to get a clean swing at the child's head without the gun being fired, you'd also be able to simply disarm the kid.

My point, we don't know how we would react unless we were in that situation. Who knows what kind of racial slurs were said at mixon, how hard she hit him, what has been said in the past. We could go through hypotheticals all day, but everyone has their moral standards and it isn't up to anyone to judge them unless we are in the exact same situation

Legally, yes. However, the state of Oklahoma also charged Mixon with an assault and he plead down to a misdemeanor "resulting in gross injury" so they likely thought he used too much force in response.

Mixon recanted the racial slurs amd spitting part of his tale after more witnesses chimed in.

Or maybe the whole category of people you just listed are scumbags including Mixon until proven otherwise.


If the kid makes attempts to at least fake being remorseful and keeps his nose clean, everyone will forget what Mixon did. I would just prefer the Jags not to be the team that gets to ride out the trial period.
