Have you read the rules? incidental contact is legal. 

It's the crown-to-helmet hits that are illegal regardless of intent. Because Church led with his shoulder, and Gronk lowered into him, it's an incidental contact between helmets. As long as it's a conventional tackle (it was) then incidental contact can happen. 

Maybe you should be certain of the rules before you decide to be condescending.

Incidental helmet to helmet contact is not legal on a receiver making a catch and hasn't been for years. This gets explained repeatedly every single season on every single play where there is helmet to helmet contact and still there are people like those in this thread who do not get it. And to add: it's not a conventional tackle, Gronkowski was still in the air and he was still a defenseless receiver, they're going to throw that flag every single time.
