That's a joke because of the thousands of Che Guevara (murderer, rapist, gay-killer) shirts they allow.

He will win because they pick and choose who to punish based on political views

I can't speak for the thousands of shirts that are being worn as reflected above, but the Policy is very discretionary which places the judgement in the hands of the school.

I don't disagree that there may be partiality in their judgement but the school will win this case if it ever goes to court.

you bet !!!   our school in Western PA was filled with classic rockers that always wore album cover type shirts ..... we would have all be kicked out !!
