I assume you reviewed the School Districts Student-Parent Handbook and their Standards of Student Conduct prior to making that above statement so I'd love to know what your basis of that assumption.  My interpretation of the policies indicate the school had every right to consider the shirt a violation.  As a result, the student has no basis to file a claim.  

See Handbook file #1 Page 10 Appropriate Dress and also Standards of Student Conduct file Page 22 Section 1.4 under Dress and Grooming.

It doesn't really matter what the school policies are, the courts (including SCOTUS) have usually sided with the student(s) in similar cases as it is a Constitutional issue.
