It's well established law on the state and federal levels that agencies have the power to promulgate regulations that have the effect of law.  Not only can they can promulgate regulations, in many instances, are part of the process in settling anti discrimination claims in employment.

Yes, there are lots of "well established" unconstitutional actions being propagated on the general public by those in power.

Just because some communists in the EEOC decided to claim that nationality=race doesn't make it true, anymore than repealing the law of gravity will allow you to fly. And in the case you presented, it was the application of nationality to hiring, so not exactly the same thing.
