If you lower to that standard, then everyone with covid could be charged since any act could be an attempt to "spread it". Kiss your wife? Terroristic act. Go to the park? Terroristic act. Want McDonald's? Terroristic act.

Also, good luck proving they actually gave it to someone and that someone else isn't responsible.

Okay, just for hypothetical sake, what if a person knew they had Covid-19 and went and visited a nursing home?  Do you think that should be prosecutable?

You can pretty much charge anyone for anything that is reckless conduct that endangers others. You just have to be able to articulate why it's reckless and why it endangers others.

I'd argue that simply having covid and visiting a nursing home shouldn't be enough unless their intent is to infect others. But that's the problem, you can't just write a law saying that having covid and visiting nursing homes is illegal or else the staff and patients are subjected to being arrested. Everyone knows that shooting a gun into the air is reckless, but everything we know about covid seems to always change, so I wouldn't feel comfortable arresting people on what-ifs.
