I'd argue that simply having covid and visiting a nursing home shouldn't be enough unless their intent is to infect others. But that's the problem, you can't just write a law saying that having covid and visiting nursing homes is illegal or else the staff and patients are subjected to being arrested. Everyone knows that shooting a gun into the air is reckless, but everything we know about covid seems to always change, so I wouldn't feel comfortable arresting people on what-ifs.

To be specific, I'm not asking about just having Covid and visiting a nursing home.   I'm asking about KNOWING you have Covid and visiting a nursing home.

It still wouldn't change much. If you're an employee, you could very well learn you have covid while working and immediately have violated the law. It's all about intent to harm. Otherwise, why don't we charge DUI drivers with vehicular homicide or aggravated assault? Operating a vehicle under the influence can just as easily kill someone as a covid-infected person could spread it to an elderly person.
