I think the problem is related to the charges that were brought against him: "Martin was charged with four misdemeanor counts: entering and remaining in a restricted building, disorderly and disruptive conduct in a restricted building, violent entry and disorderly conduct in a Capitol building and parading, demonstrating or picketing in a Capitol building."
A simple charge of trespassing may have been more applicable to those who did not force themselves into the building or demonstrated violence in the process. Correct me if I'm wrong but the judgement must be made specifically in response to the charges so the judge cannot lessen the charge on his own .... (example if you are charged for Murder 1, the jury cannot find you guilt of Involuntary Manslaughter ---- the verdict must be based on the actual charges). |
