Florida law doesn’t care whether or not you thought the person you were having sexual relations with was 18 years old or older. Florida law and Florida state prosecutors care about the actual age of the victim – regardless of how old you thought they were – when it comes to sexual abuse or sexual assault charges in Florida. 

 

Even if someone knowingly provided a fake id? Are you supposed to run a background check? 
I used my cousins id in college because we could be twins. I wasn’t trying to hook up with old dudes, I just wanted to drink like every other person on campus. Should someone go to jail because I lied about my age with proof to back it up?

Prosecutorial discretion is a thing.
Most of these kinds of situations, the authorities never even find out, and the ones they do, they can decide to look the other way.
But the law is written that way so when you find a creep who was way older and definitely abused his power against someone who was not ready for the real world, he won't be allowed to say, "I didn't know.." in court.
