You are grasping at straws.  
Neither of us were there, but we know how it was intended to work because we have the Federalist Papers and also private letters from the people involved explain how it was intended to work.
We know it did not work as intended because our fourth President, who was intimately involved in the writing process, said so himself multiple times.  
There is an individual freedom to try to make a new party, but, it will never work because the existing parties are too far ahead.  It's a systemic issue, not a legal issue.
I'm not talking about policies and I'm not trying to persuade you to vote for Democrats. 
I'm just educating you that unless there is another civil war, or unless they all get together and decide to disband and start over for some reason, neither the Democratic Party nor the Republican Party will ever die out or be surpassed by a new third party.  This is due to a combination of factors that are built into our system, that aren't present in other election systems.
