As a union employer, I had the right to ask any employee to submit to a drug test for any good reason.

 

This is enough to warrant that, easily.

 

Per union agreement, if the employee refused they were terminated.

 

The NFL isn't that harsh, but there's no evidence to me that says they can't be put in the program for such alleged behavior.  We'll have to see what comes of the 49ers own investigation.  The thing is, we don't know how many people are in stage one of the program because it isn't public.  We only hear after the fact when they fail again, and enter step 2 (only then do we ever know they were ever in step one to begin with.)
