Per union agreement, if the employee refused they were terminated.

 

The NFL isn't that harsh, but there's no evidence to me that says they can't be put in the program for such alleged behavior.  We'll have to see what comes of the 49ers own investigation.  The thing is, we don't know how many people are in stage one of the program because it isn't public.  We only hear after the fact when they fail again, and enter step 2 (only then do we ever know they were ever in step one to begin with.)

Good reason isn't someone that doesn't work for you claiming the employee was doing drugs off the job.

 

I'm not sure what union you are talking about, but I have never heard of a union allowing people to be tested at the whim of the employer unless they are found to be under the influence, and even that suspicion would have to be corroborated with other management personnel.
