Appeals don't go to Goodell. They go to a third party arbitrator assigned by Goodell. That sounds stacked against the player, but the "bountygate" suspensions by Goodell were overturned on appeal by Tagliabue who was assigned to handle the appeal by Goodell.

 

I don't think the NFL realized that their stance on not suspending NFL players for second hand smoke contradicted their own testing threshold. I think Gordon is the first, or at least the first knowingly, to test to test low enough to be attributed to second hand smoke. I think the league won't have a big problem conceding the appeal and will take measures to adjust the threshold of their testing to reflect their stance on second hand smoke.
