Did you read the link I posted reference Josh Gordon's test results?

 

There has been several articles on PFT.  One I haven't been able to find again mentioned his failed test while in the third stage of the program (which led to the year long suspension per the CBA) showed results equal to what is essentially a contact high.  I thought they mentioned something to the effect that his lawyer noticed how close the results were to that contact high level and some wording in the CBA that would allow for a chance at an appear or something of that nature.
