Wait, did you watch the video?  I've sort of changed my view on the topic.  They are both completely at fault....and she should be charged to.

 

The girl initiated all the physical contact.  She raised her hands so his response was to push her hands down.  Her response to that was to swing at him and he swung back.  I'm not saying he should have swung at her (nor would I ever), but obviously different people have different levels of defending themselves.  I may not be comfortable with swinging like that at a girl, but apparently he was.  If she's ready to swing on anyone, she better be able to deal with the consequences.
