New excuses from Brady.  Originally he said, “I wasn’t going to surrender my phone under any circumstances.”

 

Now he says: “No one said I’d be disciplined for not producing my phone.” 

 

Tom, that would be called a CIRCUMSTANCE.  And you weren't disciplined for not producing your phone.  That's a purposeful deception.  The penalties were already handed out, for lying to the investigators and for your likely culpability in the deflation scheme.  Your hearing was a chance to provide new evidence; instead you reported you had destroyed the best potential source of evidence.  So, the penalties were upheld.
