The other argument would be that scanning a license plate and running it against a database is the equivalent of a suspicionless stop, but I believe courts have upheld "stop and frisk" in the past.

 

In short, yeah, it's scary, and so are facial recognition cameras on every street corner, but it doesn't appear that courts are in any way interested in taking them away from law enforcement.
