Technically speaking (in my opinion) the officer is conducting a criminal investigation (DUI).

If this is so, then there is nothing to stop any cop from fishing any way he wants to at any time. There's nothing different about a DUI checkpoint than placing stop and frisk stations on the sidewalk at the Town Center, both are violations of civil rights and we should be ashamed that we permit it.
