Philosophically speaking, we are contrasting the foundation of Common Law (law by precedent) to the Napoleonic Code (a law for every action).  As for voting, it's true that there is no affirmative right listed, but the preponderance of the Amendments recognizes that right by listing those who can (African Americans, Women) and those who cannot (those under the age of 18).
