From reading the article, the DOJ is not reversing a clemency decision. They are re-trying the charges for which there was a hung jury. He did not receive clemency for charges on which there was no verdict. Here's another article on the subject: Philip Esformes, whose prison sentence Trump commuted, loses appeal (cnbc.com)
One thing is for sure, if this guy was able to squirrel any of that money away, the lawyers are getting it.
