Josh Gordon's appeal will be "all or nothing," either resulting in no ban at all or a full-year suspension.
NFLPA spokesman Brian McCarthy confirmed to PFT that when the league's disciplinary penalties were established 20 years ago, "the union expressed the strong view that they needed to be stated and mandatory to ensure that all players be treated the same regardless of position, experience, level of ability, or competitive considerations." If the hearing officer determines the violation was "established," Gordon will be "bound" to the one-year suspension. In other words, Gordon's ban could not be reduced to six, eight, or ten games. If the hearing officer finds there was a violation of the league's drug policy, Gordon's one-year ban will stand. If no violation is established, Gordon will be free to play a 16-game schedule barring a short ban related to his July DUI arrest.

This is an outright joke!!!

 

He's been arrested like twice since the iniitial suspension that was supposed to be for a year!

 

 

Justin Blackmon's suspension apparently has no end in sight, and this repeat offender might get off scott free with no suspension???

 

Typical Goodell letting some other team off easy, probably because they have to make sure Manziel has all his weapons so they can make sure he becomes a star....

 

Meanwhile Goodell wants no part of the Jaguars succeeding while in Jacksonville, so he'll handle Blackmon's suspension case with an iron fist. 

 

 

Gordon better be suspended for a full year, minimum!

Has any big time suspension ever been overturned?  I doubt that trend changes.

You can't say Blackmon is being treated differently because he hasn't made the details of his situation public to analyze like Gordon has. Heck, we don't even know if Blackmon made any attempt to appeal in the first place.

 

Gordon isn't appealing disciplinary action for his arrests. He is appealing the 1 year suspension for his failed drug test and he has a valid case based on the NFL's own statements.

 

The NFL's statement that they have no intention of suspending players for being around second hand smoke and their extremely low threshold for getting a positive, 1/10th the amount of any other sport and the federal work place, contradicts each other.

 

Gordon's test result of 16 ng/ml is just 1 ng over the the threshold of 15 ng/ml and is considered by experts to be consistent with the amount someone would score only exposed to second hand smoke during the week prior to the test and Gordon is claiming that is exactly what had happened to him.

 

Having worked professionally with unions for years, any ambiguity or contradiction in policy pretty much always goes in favor of the union employee. Gordon will get off of the mandatory 1 year suspension.

 

This isn't some conspiracy by Goodell. Gordon was lucky enough, or possibly his claim is the actual truth, that his score fell within the parameters of second hand smoke. He was also fortunate enough to have a legal team who were savvy enough to recognize this.

 

The bottom line is Gordon will only face whatever disciplinary action handed down for his arrests and the league will be forced to rewrite their drug policy.

This 'all or nothing' rule is an example of be careful what you ask for. It's analogous to the zero tolerance policies on school campuses where a student who has a butter knife accidentally left in their car because they were helping grandma move (actual case) being punished the same as another student who brings a weapon to school with intent is ridiculous. I'm not saying Gordon doesn't deserve his punishment, but if an appeals process proves the offense is mitigated by other circumstances then the punishment should be adjustable.

Even if they take away this year suspension, he's going to have to deal with the league on his dui arrest.  (Someone here said 2 arrests, but I was only aware of one)

 

The guy got kicked out of two colleges, and has failed multiple tests.  Even if he gets this taken care of, I'm betting he wont stay out of trouble before the next incident happens.

Was going to ask the same thing. I can't think of one suspension that has been overturned on appeal. The whole appeals process for the NFL is a joke anyway. You're essentially appealing Goodell's decision... to Goodell. Might as well just ask him if he's changed his mind in the past couple weeks, or hope you get him on a good day.

Appeals don't go to Goodell. They go to a third party arbitrator assigned by Goodell. That sounds stacked against the player, but the "bountygate" suspensions by Goodell were overturned on appeal by Tagliabue who was assigned to handle the appeal by Goodell.

 

I don't think the NFL realized that their stance on not suspending NFL players for second hand smoke contradicted their own testing threshold. I think Gordon is the first, or at least the first knowingly, to test to test low enough to be attributed to second hand smoke. I think the league won't have a big problem conceding the appeal and will take measures to adjust the threshold of their testing to reflect their stance on second hand smoke.

It always amazed me how much contempt and how stupid TMD thinks Goodell is yet he credits him with being what must be some sort of super genius to come up with such intricate and complex conspiracies.

 

It's like he can't figure out whether Goodell is too dumb to run the NFL or too smart to run the NFL.

Its likely taking so long because as I suspected, he's probably going to get off scott free or at most have a significantly reduced suspension. 

 

They want to make sure Manziel has all the weapons as possible so he has the best chance to succeed. This is all about Manziel's advertising power and monetary benefit for the NFL.

Goodell will probably let him go play this year.  He is awful.  The only reprieve is that Josh will shortly get in more trouble and be suspended again.
