The great big Blackmon thread (merged)

Right, but JB can talk to anyone at anytime about it. HIPAA says nothing about patient disolate of PHI.

Technically, league policy is just following federal HIPAA laws.  All medical information is considered personal and private.  The patient is free to disclose anything they wish at any time to anyone.  They're under no obligation to keep their information private.

Caldwell has stated many times, and it's been said in the OZONE, that the league and the NFLPA agreed that the status of players in the substance abuse program is personal and private and can not be divulged, not even to their respective teams, and there is to be minimal contact with their teams...I also know that some things get leaked, so how much can be divulged, or what can and can not be divulged , I have no idea... I already said in the post you quoted, that HIPPA laws allow for disclosure with permission from the patient... It's possible that while in the treatment phase ( inside a treatment center) is what the NFLPA and league agreed to keep under wraps, but David Caldwell said very little information is shared with teams and the public while in the NFL's substance abuse program

Understood.  There's very little information shared with the teams regarding the substance abuse program because chemical dependency is considered a medical condition that is covered under HIPAA laws.  Unless JB signs a waiver giving certain entities permission to access that information, it's not going to be shared or leaked.  Any facility, provider, or doctor who does leak that information is subject to substantial fines.  I work in this arena, so I'm dealing with it on a pretty regular basis. As frustrating as it might be, there's a reason for the laws.  It may not placate those fans who are constantly demanding more information, but that's life.

Right, I did say that information can be released with permission...Things get leaked quite often, but it's usually from the patient's agent or the patient himself...Other than that, no information can be released to outside entities...

Ultimately, I think people are frustrated because they aren't seeing any movement.  I honestly don't think we're going to see anything until probably the end of this month at the earliest because I really do believe his eligibility to apply for reinstatement is tied to that incident last July and not the date his suspension was initiated.  Otherwise, there was no punishment being levied by the league for the violation last summer, and that seems highly unlikely.

Wasn't there some chatter about him already applying but not getting reinstated?

This kid was done the moment he got pulled over for a DUI before he even signed his rookie contract. Such a waste of talent too. It's sad to see talented young guys like this throw it all away and not get the help they should when you see guys with the same talent with far better morales and decision making skills off the field not able to play due to a severe injury that cuts them short. I.e, David Pollack,Tavian Banks, etc.

One reporter made that claim, but there's nothing to indicate that's actually correct.  Nobody else has corroborated his remark.  I think he was making some assumptions.

He doesn't HAVE to disclose anything to anyone, regardless of HIPPA.  Those regulations don't apply to the patient, they apply to others (medical staff, service providers, the league, etc). The decision whether or not to release medical information is a legal privilege that lies exclusively and completely with the patient.

When you get into the endzone, act like you've been there before.

Yes I am aware of that...The patient can say whatever he chooses to about his treatment and medical history, (or say nothing at all), providing it does not violate the Substance Abuse Program and policy agreement between the NFLPA and the NFL which would be a stipulation of every NFL contract, of which as already mentioned, allows for very limited disclosure of information...

So uh...can we have a tiny bit of good news today? Please, Roger?

Gonna shock the heck out of everyone when it shoots up with a great gasp of life.
