Look at it this way. If a judge cannot preside over the trial involving someone who has expressed political opinions he is likely to disagree with, then who can preside over any trial at all? Can a Republican preside over a trial involving a Democrat?

Marshall wasn't hearing a case about a presidential candidate who will be going up against the person he's invested in. Not really a good comparison.


Trump's positions on the wall and dealing with Mexico was enough to create questions about conflict. I would venture to guess he's well aware of the judge's resume.
