Don't have to be. Mueller's directive was to investigate the Russian collusion and any other crimes that became apparent during that investigation. Well that was what Cohen pleaded guilt to. That doesn't prove that it was an actual crime, since it was never tried in court. He was guilty of many more serious crimes, but pleaded guilty to a few of the less serious crimes in order to avoid spending the rest of his life in jail.

Paying a blackmailer is not a crime, the so-called crime was that the payoff was considered a campaign contribution that exceeded the limit.

If the payoff had been from the campaign account rather than Cohen, would it have been illegal use of campaign funds for personal use? I'd think so. Edwards was charged as such. If so then using campaign funds to pay a blackmailer is a crime, and using non-campaign funds to pay a blackmailer is a crime. Apparently no matter how you do it, paying a blackmailer can be construed as a crime.
