Whew!  Good news and glad all parties can move on and put this behind them.  Of course, I hope he didn't actually rape her, not that he got off.

They just said that when she was tested she only had a .04 bal...now they didn't say how long after the fact they tested her blood.




Interesting enough for all those that said they had knew each other and had been hooking up the DA just said on TV that Winston and the girl did not know each other.

No. Toxicology reports show her that hardly any alcohol was in her system at the time.

Da just said that they guesstimate her blood alcohol level at the time of the incident would have been a 1.0 level. So there was alcohol involved. You will get arrested with a BAL of .8

I seriously doubt it.  And that's probably the way it should be.  Can you imagine rape report statistics if we jailed people who "Falsely accused rape"?

And they are not saying she falsely accused him...they are saying they couldn't prove it.

Any woman that has consensual sex with a man can later make that claim.  There's no reason for her to say he didn't do it...that would just ruin her chance at getting some easy money from a civil suit.  There's no evidence either way so it wouldn't look good for the DA to say "no, he didn't do it".

Normally there would be some signs of rape.  Bruises, scratches...signs of resistance.

What I want to know is did she bang Winston before or after she banged her boyfriend, if it was after, there is no way she was raped

Not always. Not all woman fight back...some freeze up.

Yea but there is no way you can convict with out some kinda abuse, she couldve had sex with him and felt bad later and claimed rap, and the fact that she had sex with her Boyfriend pretty much closes the case.

Which is why they can't prosecute.  One says no, one says yes.  If they had other evidence then they'd prosecute.

Okay...this case aside...no it doesn't! If I have sex with my boyfriend willingly then I get raped shortly afterward...are you saying that I wasn't raped?

Well my earlier post was, did she have sex with her boyfriend before or after Winston? with them not going with charges my guess is after, plus the no abuse and the shaky story seals the deal.

Cool.  Banging psycho chicks is still legal.
