let's start with the premise that everything ted wells and the nfl says is true. 

 

1.) The last person to not turn over their cell phone in a similar investigation was brett favre.  He was being investigated for SEXUAL MISCONDUCT!  When he didn't turn over his cell phone he was fined a wopping 50k. 

 

2.) there have been teams and personnel caught violating the same rule when expressly warned by the league not to put balls in front of heaters during cold games.  Same rule, and the average fine I believe is 25k. 

 

even if the league is proven beyond a shadow of a doubt to have taken due diligence in assessing wrong doing and collusion to subvert the investigation, the previous fines for each were nothing compared to the smack down that Brady received.  In the eyes of a Judge they aren't going to count Brady as a second offender because of the previous actions of his coach. 

 

Now, lets look procedurally. 

 

1.) There is no written record of the pre-game air pressure of the footballs.  That alone would probably negate a judge issuing a warrant for phone records and the like in real litigation. 

 

2.) The most compelling piece of information in the PR campaign going on is the fact that brady DESTROYED his cell phone.  a.) The NFL had full access to the electronic devices of the alleged co conspirators.  Its possible that a judge may rule it unreasonable to then ask for the electronic device of  the most public figure of the bunch.  b.) If Brady shows, and it should be easy to do, that he does indeed change phones every few months to avoid invasions to his privacy it will show him sincere in his concern about privacy and give  a credible reason why the cell phone was disposed of. 

 

3.) By the NFLs own records kept, OFFICIALS DON'T KNOW HOW TO WORK AN AIR GAUGE!  After the AFC championship Game there were footballs inflated above the high end of the playing scale.  This is an inherent violation of the same playing rules that Brady is accused of and in some way the officials should have been censured.  There is documented evidence in the texts between the two alleged co conspirators that in one instance game balls were inflated 2.5 PSI over the legal limit and the NFL didn't do anything about it.  Couple that with the fact that in the recent weeks the NFL has basically ADMITTED that they didn't have any real protocols in place to police air pressure DURING A FOOTBALL GAME or established rules for what would happen in the event of tampering and I can see my way to an injunction. 

 

4.) It can be argued that Tom didn't receive Substantive Due Process in his appeal because Rodger Goodell was involved in both authorizing the original punishment and presided over the appeal against the strong objections of the NFL PA!

 

Last but not least, buried in the News reports under the weight of DESTROYED CELL PHONE Rodger Goodell Admitted that during the AFC Championship game the patriots initiated a new system for game day ball prep.  They used to use a certain conditioner on the balls.  Now, they abandoned said conditioner and went to a system utilizing more GLOVING of the ball.  Gloving refers to more rubbing of the ball with gloves on creating friction and texture.  EXPONENT ADMITTED as BELICHECK STATED IN HIS PRESSER, this can artificially raise the PSI in a football up to a pound.  We're talking about less than half a pound of air that they are being accused of taking out.  An impartial judge will look at this and it will seem pretty plausible that no tampering occurred. 
 

Nobody cares what you say.  The smoking gun is the destroying the cell phone. 

 

Like someone said earlier....if I'm a millionaire and I was worried about my legacy I'd be happy to turn over the cell phone chats they requested and show them how stupid they are for even thinking something was going on.  Instead he destroyed the phone.

 

At this point, anyone that thinks he didn't cheat will never be convinced.  Your kids role model is a cheater.

How could they find evidence on Brady's? 

 

Can you imagine what will happen if the court orders all the text messages from that phone to be retrieved?  This will never go to court because what they find on that phone could be very damning, and that could go well beyond football reasons.
Tom says he provided "detailed pages of phone records and all of the emails Mr. Wells requested." WAIT A MINUTE! I thought he was refusing to turn over these records because it would set a precedent in the future? Which is it, Tom? It can't be both, so there's another lie. And, phone records just means who called/texted whom and when. It doesn't provide the content of the calls or texts.

 

Also, Tom says, “I authorized the NFLPA to make a settlement offer to the NFL so that we could avoid going to court and put this inconsequential issue behind us as we move forward into this season. The discipline was upheld without any counter offer." This appears to be another lie, as a clear counter-offer was made by the league.

 

And another little too-clever construct is this one: “Most importantly, I have never written, texted, emailed to anybody at anytime, anything related to football air pressure before this issue was raised at the AFC Championship game in January." The key word here is "before". What about emails, texts, and calls placed AFTER the game, Tommy?

Tom:  Yeah, I destroyed my phone and would never have turned it over anyway.  But here's a spreadsheet of 10,000 calls and texts I made.  Now all the NFL has to do is contact each of these people and ask them politely (because you have no subpoena power over them) to give you their phones.  They are all my friends and family, but I'm sure they will be happy to cooperate if you ask them.  Yes, I know it would have been 1000% simpler to just provide MY phone, but this way I can claim I cooperated fully and claim the NFL had no interest in following up the valuable leads I gave them.

The Pats Belichick/Brady era will forever be tainted by them having to cheat to gain an advantage. 

 

Brady is so full of it and his facebook post only helps prove it.

It has also come out that Jastremski and McNally WIPED THEIR PHONES prior to handing them over to Wells.  Wells had to have the data forensically recovered and may have only recovered a portion of it.  Interesting.  Caught on video taking game balls into the bathroom.  Ordered by the NFL and Patriots to cooperate fully, they attempt to DESTROY EVIDENCE.

Also, he claims he destroys his phone every 8 months once he has finished with it. However he supplied the phone he was using prior to the one the NFL requested, so quite clearly it's not standard practice for him to destroy his phones as he didnt destroy the last one.

Brady told investigators he didn’t know the name or game-day responsibilities of a locker room attendant, a claim contradicted by the assistant equipment manager. That attendant, remember, had “told NFL Security that he had been personally told by Brady of Brady’s inflation level preference,” according to investigators.

From Robert Kraft's statement today:

 

"I first and foremost need to apologize to our fans, because I truly believe what I did in May, given the actual evidence of the situation and the league’s history on discipline matters, would make it much easier for the league to exonerate Tom Brady."

 

LOL.  Kraft actually thought agreeing to the team penalties would help Brady get off.  But Kraft had no choice in the matter.  There is no appeals process for team penalties.  Kraft's only other options were to sue the NFL or leave the NFL.  He's telling the fans who were convinced there was a "wink-wink" agreement to reduce or eliminate Brady's suspension, that he, Robert Kraft also believed there was a "wink-wink" deal.  Did Goodell back-stab Kraft, or is Kraft just stupid? 

Kraft:  "I have often said, ‘If you want to get a deal done, sometimes you have to get the lawyers out of the room." 

 

So, Kraft is suggesting he and Goodell reached some kind of personal agreement in May when Kraft agreed to accept the team penalties?  So, it was a bribe offered and accepted?  But now he claims Goodell didn't stay bought, is that correct?

 

The reality is, Kraft gave up nothing in the supposed "deal", which is why I seriously doubt there ever was a deal.  He had no option of fighting the penalties and was told by the other owners to stop acting like a jerk.  Now he's claiming he shut up because it would get Tom exonerated.  That's funny stuff.

The equivalence of the Lance Armstrong scandal. As with Lance, Brady should be stripped of all accolades and never inducted into the Hall of Fame
As it should be.

 

Can't wait until we can all move on from this subject.

 

NFLPA agrees in new CBA to give Goodell final power.

Then wants to talk about suing when he uses it.

 

Because the golden boy is in trouble?

He should just take it and move on. Let Jimmy take them 2-2. And he can come back in week 5 or whatever, beat the snot out of the whistle blowing clots.

LOL, Looks like TWO federal court cases, and a race to see which party can get the "wheels of Justice" moving first.

 

It's turning into Bad Theater now.  Brady is a fool.  Has he even thought this through?  If he somehow does win in Federal court, what does he really win?  The ability to play in an league controlled by his arch-enemy, LOL.

I heard 11 out of 12 of Brady's cell phones were deflated.
