Gotta Give It To Jameis' Legal Team
|
Quote:Last I checked this topic was about the legal team pushing back a court date.... I believe lawyers are rare in most school hearings. At least that's my understanding. It was his choice (and I'm sure his "mentors") to use a lawyer. I'm trying to figure why FSU would want to have this hearing that you're so against. The institution you support wants to hold their students to a higher standard....but since it may affect the football team everyone is mad. We show less advertisements to registered users. Maybe it's because it's also the capital, but the koolaid is STRONG in Tallahassee!!!

The hearings are intended to remove lawyers so that the accused can more easily be convicted by sub-standard procedures. You have no presumption of innocence nor even the right to confront your accuser. None of pillars of our justice system exist in that format and it's a disgrace. “An empty vessel makes the loudest sound, so they that have the least wit are the greatest babblers.”. - Plato
Quote:Or if you have your garnet and gold glasses on. This isn't a legal issue. It's a school hearing. So what's the norm? Does anyone know how these work? How often are attorneys involved? How often are they delayed? No one knows? Everyone just speculating?

So its a disgrace that the school has a code of conduct? I wonder if any other school in the country has one...... Oh wait....they all do.

A school hearing, but yes it is lawyers getting it delayed. Lawyers are one of the biggest issues with the country today (some/a lot of them, not all.)

The same can be applied to this case. The students going to FSU are, or should be aware of the procedures in place at FSU and how it works. Also, the system isn't set up to more easily convict. Not how it works.

55 institutions from Ivy League on down are currently under investigation for unfair review practices predisposed against the accused. But you all keep your fingers in your ears, there's nothing going on here.

Attorneys are involved when you have a huge insurance policy to protect your "draft-ability" that was applied for after the "rape" incident and before the point shaving started to pay for that huge policy... or this isn't America.

If nothing was done, there's nothing to be worried about, right?

It's been found across the country that these types of hearings are not just. But we're straying very close to politics here. With a crime that has such serious repercussions for both the accused and the victim but is so hard to prove, I'm not sure what the answer is.

FSU isn't the other schools across the country. FSU fans on here are jumping all over those who have been on Winston even though he hasn't done anything wrong. Why not let the whole process take place and not simply assume the school is doing something wrong. It's a bit hypocritical I think. I'm confused now.

I can't speak for all of them, but personally I feel the school shouldn't be responsible for investigating rape. That should be the police. I feel the process has taken place and the evidence doesn't support charging him with any wrongdoing. The school however, is required to conduct an investigation and hearing even if they feel the evidence suggests nothing happened and also legally required to disregard findings by law-enforcement.
There's one fairly well-known case where the guy was found guilty by the university tribunal and punished (in Ohio I think), while the girl was being charged by the police with filing a false report. The school isn't doing anything wrong other than going along with an obviously flawed process that they are required to follow. I feel that even in this scenario, however, because Jameis has a lawyer that managed to get him an experienced judge and will work to make sure facts get in that wouldn't normally, there will be no punishment and it won't affect Jameis anymore than it already has. So it's not for Jameis' sake that I want the process changed or abolished, but all the others that don't get good lawyers able to affect the outcome. We show less advertisements to registered users. Were you a proponent of getting rid of this system before this happened? It really seems you are looking out for the students here.

I wasn't aware of the Title IX requirements on these cases before Jameis got involved, no.
Like most everyone, I was aware of the Duke lacrosse debacle in general terms, but didn't know many specifics until FSU's situation got me reading. Those articles lead me to my current beliefs even while I was convinced that Jameis did nothing wrong and the system will bear that out. |
