The thing is, it's The President's duty to appoint a replacement like it or not.  What is pivotal and important is the person nominated.  It needs to be someone that refers to The Constitution when making a ruling.  Sadly, both of the last appointments made by the current President have been partisan Activists with an extreme left leaning agenda.  He has to do better than Sonia Sotomayor or Elena Kagan.  A nomination similar to either of them will most certainly be blocked (rightfully so) by The Senate.  Turning The Supreme Court into a partisan arm of any political party is most certainly a way to doom the country.

I think it's fair to say most 'criminals' buy their guns legally. It's not like they need to utilize a black market. They can just go to a gun show and pay cash.


I'm not sure I follow the logic of cracking down on 'criminals' as opposed to the general public.
You do realize felons and those with domestic violence and other similar records cannot legally own firearms, right? There are people who have been convicted of certain crimes who should never be able to legally own a firearm. And if they don't own them legally then yes, they should be confiscated.

 

And I don't know what gun shows you've been to but the ones around here require background checks on the spot for hand guns and a call to the sheriff's office of the county you live in to check for a felony, domestic violence and repeat offender assault record if you plan to buy a long gun. You do not leave that building with a firearm without having a check done no matter how you pay for it. We've been to many gun shows and it's the same at every one of them. You don't leave any legal firearm selling establishment without these checks. I don't know how it is in other states but it's how we do it here in NC.

 

And what is the difference between a 'criminal' and a criminal?

You're exposing how little you know on this topic. A criminal can not show up at a gun show and pay cash. They still do instant background checks at gun shows. The only difference is the 3 day waiting period is waived on hand guns for non ccl owner's.

I thought there are private sellers at gun shows that are completely unregulated -- not licensed dealers. Correct me if I'm wrong please.

I was aware of the rule about felons but not domestic violence. Never heard that before. That's a good thing. I am trying to clarify which criminals we are talking about tho. Point being it seems there could be more done on the front end before they use the gun to become a criminal. And it is much less about taking guns from legal owners and much moreso about restricting who can become a legal owner before they become a criminal.

Good question. One option might be a medical screening. There could be a check done to see if are actively taking anti-psychotic medication. Cross check that with members of the household too. Sandy hook comes to mind. That kid should never been allowed to have access to guns.
