McDonald's doesn't actually sell the food, though, and they don't have to pay for the repairs to the machines.  McDonalds' business model is to make money by leasing land to the franchisees.   The franchisees have to buy the machines and pay to get them repaired.   

And even if they did have to pay for the repairs, $80 million is such a small amount of money to the McDonalds Corporation that it's not even equivalent to a rounding error.  

To me, it appears that the Taylor company has found this little niche, this little crack, and they've exploited it because it's not a big enough deal for anyone to do anything about it.  

Until, that is, some FTC employee gets tired of being told for the umpteenth time that he/she cannot have a McFlurry because the machine is broken.  Don't mess with the deep state!
