Congress already gave the President that authority. NBC just didn’t tell you.
THE LAW: Congress Already Delegated Immigration Enforcement to the Executive
8 U.S. Code § 1227 & § 1231 (Immigration and Nationality Act)
Congress clearly authorizes the executive branch to detain and deport “any alien” who is unlawfully present or a threat to national security.
§ 1231(a)(6) specifically allows for the indefinite detention of certain aliens deemed dangerous or removable.
The courts have ruled this applies to foreign nationals-not U.S. citizens.
CONSTITUTIONAL BASIS: Article I, Section 9, Clause 2
“The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.”
It does not require a formal vote of Congress.
Only that the condition of invasion or rebellion exists.
SCOTUS PRECEDENT: Ludecke v. Watkins (1948)
The Supreme Court ruled that enemy aliens can be detained without habeas corpus under the Alien Enemies Act-especially in wartime or during national threats.
Alien Enemies Act (50 U.S. Code § 21)
Authorizes the President to apprehend, restrain, and remove foreign nationals who pose a threat-without judicial review during war or invasion.
What NBC Left Out:
️The legal distinction between citizens and foreign nationals
️That Congress already delegated deportation authority under the INA
️That SCOTUS has upheld that non-citizens during national security threats are not entitled to the same habeas rights
️That the Constitution permits suspension of habeas under invasion-which the administration has declared is occurring

There is no rebellion or invasion or war.

As Democrats attack President Donald Trump for accepting the Qatari royal family's gift of a $400 million jet to be refurbished to serve as Air Force One, photos have resurfaced of some Democratic lawmakers three years earlier enjoying an expenses-paid trip to the Gulf emirate.

The trip, paid for by the U.S.-Qatar Business Council, involved four House Democrats and one Republican who went to Qatar in 2021. During the trip, at least two of the Democrats participated in a sightseeing excursion via camelback for them and their family members.

While the trade group that footed the bill for the Democrat excursion is not directly tied to the Qatari royal family, it describes its work as "dedicated exclusively to enhancing the bilateral business relationship between the U.S. and Qatar."

Man, that's comparing firecrackers to nuclear bombs. Not worth our time. 

Nothing like this gift of a jumbo jet has ever happened before.  Honestly I think it would be fine, if our government kept the plane afterwards for the next President.  Trump should not be allowed to keep such a gift for himself, obviously they wouldn't be offering if he wasn't President right now.

If I had to predict, there will be back channel discussions and the Qataris will withdraw the offer.
