Were you sick the day they taught civics in school? Here's a little hint. Appellate courts are Constitutionally placed to review and vet the decisions of the lower courts. In this particular case, no judgement/decision was ever rendered. A stay was issued, which is far from being a judgement. The correct action would have been to remand the case to the lower court with instruction to issue a formal judgement. This is nothing new for the 9th circuit court though. They tend to try to legislate from the bench. This ruling will be smacked down by the Supreme Court soon enough.


The 9th circuit court has more important problems facing them as it is. That appellate district has been maligned for years, and Congress is in the process of splitting it up and creating a 12th circuit court. The Judges would be appointed by the President and Congress. The end result will be a huge reduction of the power and IMO, overreach of the judicial system.


This ruling didn't surprise anyone. It is par for the course for that court. Trump does love his theatrics though. In reality, this is pretty much non news. It makes the commie libs happy though, and they haven't had anything to be happy about in months.
