Were you sick the day they taught civics in school? Here's a little hint. Appellate courts are Constitutionally placed to review and vet the decisions of the lower courts. In this particular case, no judgement/decision was ever rendered. A stay was issued, which is far from being a judgement. The correct action would have been to remand the case to the lower court with instruction to issue a formal judgement. This is nothing new for the 9th circuit court though. They tend to try to legislate from the bench. This ruling will be smacked down by the Supreme Court soon enough.


The 9th circuit court has more important problems facing them as it is. That appellate district has been maligned for years, and Congress is in the process of splitting it up and creating a 12th circuit court. The Judges would be appointed by the President and Congress. The end result will be a huge reduction of the power and IMO, overreach of the judicial system.


This ruling didn't surprise anyone. It is par for the course for that court. Trump does love his theatrics though. In reality, this is pretty much non news. It makes the commie libs happy though, and they haven't had anything to be happy about in months.

I think the Federal courts' efforts to curtail Trump's lawful authority over this issue just goes to show you how much a court can abuse their power. 

 

You may not agree with it, but this is included in his power. There's nothing illegal about it.

Instead of fighting the courts, why not accept defeat when warranted?


 

Trump should accept that his executive order failed, and then while taking into account all of the legal reasoning presented as to why it failed, come up with an entirely new executive order. In this manner he can establish a better relationship with the courts while doing what it takes to protect our nation from ISIS


 

 

...at least do this much should it also fail in the Supreme Court... there's no reason to fight an internal war when we have a war with ISIS to fight.

The 9th district has historically been the most overturned appellate court in the country. This decision will simply solidify that status.

The congress dully delegated the authority to the executive to bar "any alien for any class of aliens whos entry into the country could be contrary to the national interest and restrict any alien or class of aliens in any way for any amount of time that he deems appropriate."  As Trump correctly stated, a bad high school student can read the intent of the statute.  That statute was dully passed by the congress which is given FULL AUTHORITY over immigration in the constitution.  The idea that this doesn't meet constitutional muster because we are inventing due process rights for non resident aliens in other countries who have never been to this country.

In a way he can't.  1.) As I stated above THERE IS NO LEGAL REASONING for the court to overturn this executive order.  If they don't like it or don't agree with it then that doesn't mean that they have the power to curtail or abolish the power of the executive to exercise its authority over immigration specifically in the arena of national security.  2.) THIS IS THE FIGHT AGAINST ISIS.  That's why the executive has this power.  If the courts are allowed to [BLEEP] our ability to secure our nation against potential threats without clear evidence of encroaching the constitution then there's no point. 

 

The only reason the left did this is because this was the most liberal circuit in the federal appeals circuit, Sessions had yet to be confirmed so this guy that argued on behalf of the federal government was a third stringer not loyal to the administration and because Gorsuch isn't yet confirmed, the Supreme Court is Split 4-4 and it would take a full 5 justice majority to overturn the ruling. 

 

The President swore an oath to defend the constitution of the united states.  That extends to the powers of the executive and those delegated by congress.  That includes protecting them from an imperial judiciary.

Depressing to see the court act like un-elected tyrants and usurp this much power. Removing the constitutional and historic power of the executive branch to regulate immigration? A seriously bad move and the damage this will cause would be insurmountable.

 

HOWEVER,

 

The 9th circuit has the HIGHEST reversal rate in the US on cases that go to the Supreme Court. The EO is fully within the executive branch's legal authority. It should be reversed.

As been said already, there is no defeat, but let's assume it goes to the Supreme Court and does (not likely). As been done before with other Presidents, he will have the EO or law rewritten to address the issues brought to light by the courts, essentially circumventing their ruling. While I do believe the POTUS has a constitutional ground in this matter, I also believe the White House and lawyers may have an ulterior motive in seeing for future reference just how far they can push. Certainly would not be a first in Presidential history.

President Trump should take a page from obummers book and simply ignore the ruling. There is nothing that says he has to abide by an unlawful ruling. obummer routinely did it.

I think someone needs to take Trumps phone away so he can stop tweeting.

 

He tweets about how Nordstrom is being unfair to Ivanka. SNL skits. The apprentice. He occasionally tweets out something about being president but he's so concerned with his public appearance because he feels the needs to comment about everything.
