Lol, they can sue if they like, they will lose. All hospitals and health systems in our region have made inoculation a requirement for employment, both public and private, adding the Covid 19 vax to the list of vaccinations required for employment. Florida protects freedom just fine, yet our regulations are lawful and enforceable because vaccination status has long been held up as essential to protect the healthcare workforce. I'd really be interested to know your occupation since you act like a lawyer, doctor, and pharmacist on here yet continually give such terrible advice. Like your CDC reference where it says "The Federal government does not mandate vaccination for people" and not "employees", because that's a stark difference. Do you actually do any of these things or are you just a hobbyist?

Not usually, there has to be a mitigating reason why you would be awarded unemployment in that case, and I doubt that refusing the vaccine will qualify.

You might be wrong about this one. There have already been 2 cases where someone who had Covid was granted protection from being fired because they didn't want to take the vaccine. So far that I know, Covid is the only disease that we are making people take the shot once they've been inoculated. This might change once we drop this herd immunity farce and the CDC acknowledges this will be more like the flu.

At least. This is the single issue that has me hot about the rollout.

In return for laying off those who were sick, the CDC can recommend that we start vaccinating our pets. Big Pharma can make their money that way. Gonna name my next dog Booster.

As of 9/1/21 the EEOC has unequivocally declared that employers have the right to terminate those who will not comply. If some yocal judge has said otherwise then I suspect that judge will get overturned by the Circuit Court. The Feds, notoriously pro-workers rights, are in favor of the employer in this case; almost unheard of in the last 50 years.

You can get unemployment if you state you are quitting because of this policy and it going against your beliefs. They legally can't deny a religious exemption if you say the right words but they again they are ignoring the constitution and all precedent.

It will depend on the state but better for them to fire you and put it in writing. They could still try to fight unemployment with you breaking their rules.

Declaring and writing rules are not laws. There are laws with respect to EUA drugs and until the EUA is removed or the approved drug is available in the US, there is no available, approved drug for anyone to take. There are state, federal, and international law all stating you cannot be forced or threatened into taking it.

There is also no amendment to the constitution granting the federal government the power to set vaccine mandates. That power then belongs to the states. The states have to be the ones to do it.

Having OSHA write a rule tries to get around the federal government setting the mandate but they will still lose. Their hope is companies do it anyways and fire everyone, which will crash the economy before their policies do it.

There you go again. Your position was already reviewed and dismissed back in June in the Houston Methodist case, before FDA approval of any of the vaccines, with the federal judge declaring your petition on the EUA and experimentation both false and irrelevant. Precedent is set, but more frivolous lawsuits are sure to be filed, and just as sure to be tossed out. Try something else Counselor, that stategy failed.

Also, If I am not mistaken, I think that just before OSHA was tipped as the head of the spear, they also stopped requiring employers to collect safety data on the vaccines.

Pfizer wasn't even requiring vaccine mandates of their employees. They have said they are going to start, but, as of a week ago, official company policy still said it was optional.
