If the facts are as you state, then I think she committed murder.  She used her boyfriend to murder her husband just as if she used a gun to murder him.

Not to me.   If she was the instigator, then she was the cause of her husband's death, and like I said, whether she used a gun or a hit man, she is guilty of murder as far as I'm concerned.   It's the same as if a mafia don got one of his underlings to kill someone.   He'd be guilty of murder, too.  In many cases the guy who pulled the trigger has flipped and gone into witness protection, and the mafia don who ordered the murder got convicted of murder.

Not really.  You want to get a conviction.  It's a lot harder to get a conviction than you might think.  Having someone confess goes a long ways.
