Newport, DE - On November 30, 2010 shortly before 8PM, Nigel Sykes forced his way into the back door of Seasons Pizza to commit armed robbery with a handgun. <a class="" href='http://www.rantlifestyle.com/2014/01/29/2014-state-union-20-quotes-obama-equal-pay-wages/?utm_medium=referral&utm_source=LinkSmart'>Employees</a> began wrestling with Sykes for the gun, and in the struggle the gun discharged hitting a nearby trash can, and narrowly missing a Seasons <a class="" href='http://www.rantlifestyle.com/2014/01/29/2014-state-union-20-quotes-obama-equal-pay-wages/?utm_medium=referral&utm_source=LinkSmart'>employee</a>. Sykes is now alleging that the force used on him was “unnecessary,” and the man is suing for $260,000 after robbing them at gunpoint!

no chance, you can sue for anything but this will be laughed out of court. I'd like to know what idiot lawyer is presenting this case if any at all.

The minimum mandatory prison sentence for discharging a firearm in a robbery attempt in FL is ten years in prison. He could have killed someone. Hopefully the judge throttles this punk.

Just to be the devil's advocate on this, if the facts are as he has alleged, he has a point.   You have to follow the law and the constitution.   If you capture a criminal, at the point that he is defenseless, you are not allowed to be judge, jury, and executioner.   He is alleging that he was captured and defenseless and at that point he was administered a severe beating, and had boiling hot soup poured on him as he was held down.  

 

If he tried to rob the store, he is a criminal.   On the other hand, people who beat defenseless prisoners are also criminals.

 

Recently, a man in Detroit hit a child with his truck.  When he got out, a mob beat him half to death.  They became judge, jury, and executioner, and beat a man half to death. 

 

We don't allow mob justice or lynching.  We all have constitutional rights.

The only thing I could think of it being detrimental is if he started maybe developing a bad rep because of it, and that could possibly hurt "business" for him.

See the story on the dad who beat the absolute hell out of the 18 year old who he caught in the act of raping his boy, (4 or 5 I think). Beat the kid absolutely senseless, face looked unrecognizeable. Police said the dad was justified in the beating. Guy could have stopped the 18 year old and simply held him til police came here too.

 

If someone comes into a place of business, or your home with the intent to rob you (or more),  in this case the guy in the original post had a gun. The person doing the robbing (or more) better be ready for some repercussions if his evil intent is foiled by the owner of the business or home.
